| Durango Bill's Jason Gastrich and DMCA Abuse |

| Jason Gastrich has invoked abusive use of the Digital Millenium Copyright Act (DMCA) to try to stop my criticism of him. The DMCA allows you to make a claim (frivolous, untrue, malicious persecution, whatever) that someone else is violating your rights under the copyright laws. If you file such a claim with the web host of another website, the web host is required to shut the web site down unless the site owner removes the material first. (Think of being away on a business trip, vacation, etc. and you don't know that a claim has been made against you.) In any case the material is removed from the Internet. As a website owner, you are declared guilty with immediate punishment applied. Forget about the 4th Amendment, due process, etc. You are declared guilty. You then have to prove yourself innocent. Jason Gastrich and other cultists have used the DMCA as a terror weapon to silence critics. | Please note the statement: "Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright." Just using the enlarged print yields a very clear statement concerning the Copyright Law: "…the fair use of a copyrighted work, including such use by reproduction in copies…for purposes such as criticism… is not an infringement of copyright."
